Terms of Service & Data Aggregation Agreement

By purchasing, viewing, or otherwise using a report from isthecarclean.com ("we", "us", the "platform"), you agree to the following terms. For a one-time fee of $9.99 per VIN we produce an automated, independent market footprint audit — a three-tier status, a valuation band, and a flag-linked inspection checklist.

1. Data aggregation & "as-is" basis

The platform compiles its analysis from licensed and publicly available data — including the MarketCheck API, manufacturer-derived specification decodes, public listing and auction history, and third-party commercial databases. This data originates with parties we do not control. Reports are provided strictly "as is" and "as available." We do not warrant 100% real-time precision, completeness, or historical continuity of any data point, and source records may be delayed, partial, or in error. Each report reflects available market history from the past six years; records outside this window may not be captured.

2. Market Footprint Status — an algorithmic opinion

Our Market Footprint Status (a three-tier badge — No Flags Detected, Flags Detected, or Significant Flags Detected) and dynamic inspection checklists are an independent market footprint audit generated automatically from the aggregated data described above. The status reflects an algorithmic "system opinion" of the flags surfaced in available listing data only. It does not constitute a physical or mechanical vehicle appraisal, a mechanical or roadworthiness warranty, or a binding title-history certification. A "No Flags Detected" status does not guarantee a vehicle is sound, and a "Significant Flags Detected" status does not guarantee it is defective.

3. Disclaimer of warranties & limitation of liability

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. You are solely responsible for your own purchasing, negotiation, and deposit decisions, and you agree to verify all material facts through an in-person inspection and official sources before acting. To the fullest extent permitted by law, you agree not to hold the platform or its operators liable for lost deposits, negotiation outcomes, or other financial losses arising from your use of a report, and our total aggregate liability for any claim is limited to the amount you paid for the report at issue. Nothing in these terms limits any liability that cannot be limited under applicable law.

4. Commercial & seller neutrality

The platform operates independently of any vehicle manufacturer, dealership, retail dealer network, insurer, or government title registry, and is not affiliated with or sponsored by any of them. Our output is an objective, automatically generated market footprint audit, produced without commercial malice toward, or preference for, any seller or vehicle.

5. Payment & refunds

Payments are processed securely by Stripe. Because each report incurs real-time data and analysis costs the moment it is generated, fees are generally non-refundable once a report is compiled. If a report fails to generate due to an error on our side, contact us and we will re-run it or refund you.

6. Acceptable use

You agree to use the service only for lawful, private, personal informational purposes and only to evaluate vehicles you have a legitimate interest in. You may not scrape, resell, or redistribute reports, or attempt to circumvent billing.

7. Data accuracy & removal requests

Because our analysis derives from upstream registries and third-party databases, an upstream lag or error can occasionally surface in a report. Sellers, dealers, and individuals may request review or removal of a specific data point by emailing hello@isthecarclean.com with the subject "Data Accuracy / Removal Request." Please include the VIN, the specific value you believe is inaccurate, and verification proof (e.g., title, registration, or the corrected upstream record). We will review verified submissions and correct or suppress confirmed errors.

8. Changes

We may update these terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the revised terms.
